Scope and Subject of the Contract

AquaTrack provides a digital platform for analyzing, monitoring, and optimizing water consumption data, as well as for planning environmental solutions. Use is based on these terms.

The platform includes sensor data integration, dashboards, reporting functions, and consulting modules. The exact scope of functions is determined by the respective service level booked.

User Obligations

You are responsible for the accuracy of the data you provide and for the secure handling of your access credentials. Sharing your account with third parties is not permitted.

Using the platform for purposes that violate applicable law or infringe on the rights of third parties is prohibited. In particular, interfering with system integrity and reading third-party data is forbidden.

• You undertake to keep your access credentials confidential.
• You are liable for all activities that occur under your account.
• You may not use the platform for fraudulent or illegal activities.

Availability and Liability

AquaTrack strives for high availability of the platform but does not guarantee uninterrupted or error-free operation. Maintenance work will be announced whenever possible.

Liability for damages arising from the use of the platform is limited to intent and gross negligence. Liability for indirect damages or data loss is excluded to the extent permitted by law.

Limitation of Liability

The analyses and recommendations provided on the platform are for decision support. They do not replace professional on-site inspection. Liability for the accuracy of forecasts is excluded.

Data Protection and Security

The processing of personal data is carried out in accordance with our privacy policy. We take appropriate technical and organizational measures to protect your data.

Using the platform requires consent to the collection of usage data. Please refer to policy.html for details.

• We only store data necessary for the operation of the platform.
• Disclosure to third parties only occurs with your consent or on a legal basis.
• You have the right to access, correct, and delete your data at any time.

Intellectual Property

All content on the platform, particularly texts, graphics, logos, and software, is protected by copyright. Use is only permitted within the scope of the contractual purposes.

Reproduction, distribution, or public availability of the content requires prior written consent from AquaTrack.

Changes and Termination

We reserve the right to change these terms with reasonable notice. You will be informed of material changes by email. If you do not object, the new terms will be deemed accepted.

You may terminate the use of the platform at any time. AquaTrack may block access without notice in the event of a breach of these terms or payment default.
